Board Minutes- June 2, 2014

BE IT REMEMBERED that the Board of Supervisors of Winston County, Mississippi, held a meeting at the Courthouse inthe City of Louisville, Mississippi, at 9:00 am, this the 2nd day of June, 2014, the same being duly noticed and posted to all necessary parties.


Present and constituting the Board was Honorable James “Burr” Warner, District One; Honorable Luke Parkes, District Two; Honorable Mike Peterson, District Three; Honorable Gloria Turnipseed, District Four; and Honorable Larry Duran, District Five. Also present were Board Attorney Hugh Hathorn, Honorable Jason Pugh, Honorable Julie Cunningham, Chancery Clerk of Winston County, Honorable Larry Woodward, Tax Assessor-Collector of Winston County, Madison Barnett from The Winston Coun Journal, Brenda Miles, and EL. Miles. Also present were William McCuIIy from Winston Web News, WCCRCF Warden Neal Higgasonl Billy Holmes, Bessie Holmes, Carolyn Hampton, Charles Hampton, and Buddy King, EMA Director, and Jodie Garrard, Assistant EMA Director.

At the time of this meeting, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor ofthe State of Mississippi and the President of the United States.

The Board, having been declared in session at 9:00 am, by Neal Higgason, WCCRCF Warden, with Honorable Mike Peterson, President of the Board of Supervisors presiding, proceeded with business as follows, to-wit:





ORQER TO AMEND AND REVISE THE DEBRIS REMOVA_L CONTRJA_CT WITH HUGHES CON§TRUCTION COMPANY

CAME ON FOR CONSIDERATION at the request of Hugh Hathorn, Winston County Board of Supervisors Attorney, to amend and revise the Debris Removal Contract between Winston County, Mississippi, and Hughes Construction Company, by amending paragraph 3.3 of the contract and attaching a revised and amended fee schedule to said contract. The Board finds that it is in the best interest of the County and will help the County maintain more accurate records on the debris removal if the

tipping fees at the landfill are paid directly by the County rather than having the tipping fees included in the amount paid to the Contractor and then having the Contractor pay the landfill fees. Therefore, it is necessary to amend the Debris Removal Contract to reflect that Winston County will pay all tipping fees at the landfill on tornado debris removed by Hughes Construction Company and an amended price schedule will be attached to the contract with Hughes Construction Company to reflect that the prices paid to the Contractor will not include the $18.00 per ton tipping fee at the landfill

ORDER ACKNOWLEDGING CENTURY CONSTRUCTIQ_N AND REALTY COMPAM, INC. EASE BID OF $44,850.00 FOR TEERS BU|I_._DING, CHURCH SlREET, LOUISVILLE MS , CSE214048

CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, acknowledgment of the base bid of $44,850.00 by Century Construction and Realty, Inc. for demolition at the Teters Building, on Church Street, Louisville, MS. At the time of this action, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.

The Board finds that the provisions of Section 33-15~17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to timeconsuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

After discussion and upon said request, Motion was made by Honorable Luke Parkes and Second by Honorable Gloria Turnipseed to acknowledge said base bid by Century Construction and Realty, ino.

CAME ON FOR CONSIDERATION at the request of Winston County Board Attorney Hugh Hathorn, approval ofthe amendment to the Master Services Agreement with Broaddus & Associates by adding a sentence to the end of Section ‘1, paragraph 1 to read “Services may also include the administration of Insurance, FEMA/MEMA, Hazard Mitigation Grant Program Community Development Block Grant program (“CDBG”), provide consulting services to client for categories A, B, C, D, E, F & G, and other grants, state or federal monies.”

CAME ON FOR CONSIDERATION at the request of Purchase Clerk Crystal Clark, approval to open bids for supplies for 'ñscal year 2014-2015.

After discussion and upon said request, Motion was made by Honorable Luke Parkes and Second by Honorable Gloria Turnipseed to open said bids. Said bids were opened and on Motion of Supervisor Parkes, seconded by Supervisor Turnipseed, the Board elected to take the bids under advisement for further review.
