Board Minutes- May 5, 2014

BE IT REMEMBERED that the Board of Supervisors of Winston County, Mississippi, held a regularly scheduled meeting at the Courthouse in the City of Louisville, Mississippi, at 9:00 am, this the 5th day of May, 2014, the same being duly noticed and posted to all necessary parties.


Present and constituting the Board was Honorable James “Burr’I Warner, District One; Honorable Luke Parkes, District Two; Honorable Mike Peterson, District Three; Honorable Gloria Turnipseed, District Four; and Honorable Larry Duran, District Five. Also present were Board Attorney Hugh Hathorn, Honorable Jason Pugh, Honorable Julie Cunningham, Chancery Clerk of Winston County, Honorable Larry Woodward, Tax Assessor-Collector of Winston County, Joseph McCain from Lhe Winston Coun Journal, Evangelist Maria Triplett, Deputy Keith Alexander, and Cynthia Norland. Also present were William McCully from Winston Web News, WCCRCF Warden Neal Higgason, Billy Holmes, Bessie Holmes, Jimmy Kemp, Juliette Reese and Junie Fuller from Community Counseling, Spence Broocks and Phylis Benson of GTPDD, Coroner Scott Gregory, AI McClaran, Gerald Mills, Stanley Spradiing, Leo Wood, Charles Hampton, and Buddy King, EMA Director.

At the time of this meeting, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of

Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.

The Board, having been declared in session at 9:00 am, by Honorable Jason Pugh, Sheriff of Winston County, Mississippi, with Honorable Mike Peterson, President of the Board of Supervisors presiding, proceeded with business as follows, to-wit:

CAME ON FOR CONSIDERATION at the request of Buddy King, Winston County Emergency Management Director, approval for certification of four points of distribution in Winston County due to the April 28, 2014 tornado damage: Louisville Coliseum, Mars Hill Fire Department, Noxapater Fire Department, and Center Ridge Baptist Church.

After discussion and upon said request, Motion was made by Honorable Luke Parkes and Second by Honorable Burr Warner to certify said points of distribution.

approval for the purchase of binders for the Accounts Payable office, not to exceed $300 from Dement Printing.

ORDER FQR DEMAND CHECK PAYABLE TO CRYSTAL CLARK, $85.30 AND §104.02rFOR EMERGENCY PURCHASES MADE FOLLOWING APRIL_2_B, 2014 TORNADO

CAME ON FOR CONSIDERATION at the request of Honorable Julie Cunningham, approval for a demand check payable to Crystal Clark for emergency purchases made following the April 28, 2014 tornado: $85.30 and $104.02.

At the time of these purchases, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of

Alderman of the City of Louisville, the Governor ofthe State of Mississippi and the President of the United States.

The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies ofthe extreme emergency situation without regard to timeconsuming procedures and formalities prescribed by law pertaining tothe performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

After discussion and upon said request, Motion was made by Honorable Larry Duran and Second by Honorable Gloria Turnipseed to approve said demand check.

CAME ON FOR CONSIDERATION at the request of Honorable Burr Warner, approval for a demand check in the amount of $173.88 for reimbursement of emergency purchases made following the April 28, 2014 tornado.

At the time of these purchases, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.

The Board finds that the provisions of Section 3345-1709), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to timeconsuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

CAME ON FOR CONSIDERATION at the request of Honorable Sheriff Jason Pugh, approval for the temporary hire of David Sullivan at $9.00 per hour and William Woodward at $10.00 per hour effective April 28, 2014.

At the time of these hires, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman

of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.

The Board finds that the provisions of Section 33-‘15-17(b), Miss. CODE ANN.
