Board Minutes- May 14, 2014


Emergency Meeting.l Project Manager for Debris Removal and Monitoring Services
BE IT REMEMBERED that the Board of Supervisors of Winston County, Mississippi, held a meeting at the Courthouse in the City of Louisville, Mississippi, at 9:00 am, this the 14"1 day of May, 2014, for the purpose of discussing imminent threats to the safety of the public health and safety of our citizens caused by the April 28, 2014 tornado. Said tornado devastated many areas of Winston County, Mississippi, and the Winston County Board of Supervisors was seeking the help of State and Federal Government entities. At the time of this meeting, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.


Present and constituting the Board was Honorable James “Burr” Warner, District One; Honorable Luke Parkes, District Two; Honorable Mike Peterson, District Three; Honorable Gloria Turnipseed, District Four; and Honorable Larry Duran, District Five. Also present were Board Attorney Hugh Hathorn, Honorable Jason Pugh, Honorable Julie Cunningham, Chancery Clerk of Winston County, Honorable Larry Woodward, Tax Assessor-Collector of Winston County, Joseph McCain from @Winston Count Journal, and Deputy Keith Alexander. Also present were William McCuIIy from Winston Web News, FEMA and MEMA representatives, DEQ representative Jason Bridges, Corps of Engineers representatives, and Buddy King, EMA Director.

The Board, having been declared in session at 9:00 am, by Honorable Jason Pugh, Sheriff of Winston County, Mississippi, with Honorable Mike Peterson, President of the Board of Supervisors presiding, proceeded with business as follows, to-wit:

CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, approval for the acceptance of a service agreement from Broaddus & Associates. The Board finds that due to the emergency declaration in effect by the Board of Supervisors, the City of Louisville, the Governor of the State of Mississippi and the President of the United States that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the heatth and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to timeconsuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds. However, the Board finds that in order to be eligible for reimbursement of expenses from MEMA and FEMA, it must follow certain procurement practices which include seeking competitive proposals for the removal of debris and the monitoring ofthe debris removal, including seeking these services from minority owned businesses. Further, the Board of Supervisors does not have the personnel or the expertise to undertake the solicitations of proposals and finds that it is necessary to contract with a firm who has the experience and expertise in disaster situations to manage the county’s efforts to remove debris and restore order to the county. Therefore, the Board of Supervisors finds that it should employ a disaster project manager to assist the county in sending out requests for proposals for debris removal and for monitoring services for debris removal for all areas of the county

outside the municipal limits ofthe City of Louisville in need of cleanup due to the tornado disaster of April 28, 2014.

Five proposals were received and considered by the county with proposals being received from (1) Storm Recovery Services; (2) Southern Disaster Recovery; (3)

Broaddus & Associates; (4) Thompson Engineering and Consulting Services; and, DRC Emergency Services.

After review of the experience, expertise and qualifications of each tirm and the needs of Winston County, and after discussion, Motion was made by Honorable Burr Warner and Second by Honorable Gloria Turnipseed to enter into a service agreement with Broadd us, Associates to act as the disaster project manager and grant administrator for Winston County.

ORDER AUTHORIZING BROADDUS & ASSOCLA_TES TO SOMIT REQUESTS FOR PROPOSALS FOR @BRIS REMOVAL. AND MONITORING SERVICES

CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, authorization for Broaddus & Associates, Project Manager for Winston County, to solicit Requests for Proposals for debris removal and monitoring services. The Board finds that it is necessary to enter into a contract for the removal of debris and for the monitoring of the debris removal in order to protect the lives and property of the Citizens of Winston County. Specifically, the Board finds that citizens of the county are endangered by the debris left in the public roads and public road rights of way by the tornado which struck Winston County on April 28, 2014. Further, the Board finds that the county may be entitled to be reimbursed by the Mississippi Emergency Management Agency (MEMA) and the Federal Emergency Management Agency (FEMA) for certain expenses related to removal ofthe debris. The Board finds that due to the emergency declaration in effect by the Board of Supervisors, the City of Louisville, the Governor of the State of Mississippi and the President of the United States that the provisions of Section 33-15-17(b), Miss. The Board of Supervisors having heretofore employed Broadd us & Associates as its disaster project manager now finds that Broaddus & Associates should be authorized to send out requests for proposals for debris removal and for monitoring services for debris removal for all areas of the county outside the municipal limits ofthe City of Louisville in need of cleanup due to the tornado disaster of April 28, 2014.

After discussion, Motion was made by Honorable Burr Warner and Second by Honorable Larry Duran to authorize Broaddus & Associates to solicit requests for proposals for debris removal and monitoring with said requests for proposals to comply

with MEMA and FEMA guidelines for reimbursement eligibility and with all procuremth laws.
