Board Minutes- May 12, 2014

Emergency Meeting! Requests for Proposals for Debris Removal and Monitor 9:00 am

BE IT REMEMBERED that the Board of Supervisors of Winston County, Mississippi, held a meeting at the Courthouse in the City of Louisville, Mississippi, at 9:00 am, this the ‘l2th day of May, 2014, for the purpose of discussing imminent threats to the safety of the public health and safety of our citizens caused by the April 28, 2014 tornado. Said tornado devastated many areas of Winston County, Mississippi, and the Winston County Board of Supervisors was seeking the help of State and Federal Government entities. At the time of this meeting, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.


Present and constituting the Board was Honorable James “Burr’l Warner, District One; Honorable Luke Parkes, District Two; Honorable Mike Peterson, District Three; Honorable Gloria Turnipseed, District Four; and Honorable Larry Duran, District Five. Also present were Board Attorney Hugh Hathom, Honorable Jason Pugh, Honorable Julie Cunningham, Chancery Clerk of Winston County, Honorable Larry Woodward, Tax Assessor-Collector of Winston County, Brenda Miles, WCCRCF Warden Neal ' Higgason, Joseph McCain from The Winston Countv Journal, and Deputy Keith Alexander. Also present were William McCully from Winston Web News, MEMA and

FEMA representatives, DEQ representative Jason Bridges, and Buddy King, EMA Director.

The Board, having been declared in session at 9:00 am, by Honorable Jason Pugh, Sheriff of Winston County, Mississippi, with Honorable Mike Peterson, President of the Board of Supervisors presiding, proceeded with business as follows, to-wit:



ORDER AN|_D_MINUTES OF EXECUTIVE SES§ION

During an emergency meeting ofthe Board of Supervisors held on May 12, 2014, pursuant to the terms of 25-41-7 of the Mississippi Code of 1972, as amended, Honorable Mike Peterson moved, and Honorable Luke Parkes , that the Winston County Board of Supervisors make a closed determination upon the issue of whether or not to declare an executive session for the purpose of discussing personnel issues and litigation with the following named persons deemed necessary for the discussions, deliberations, and recording of such executive session:

Burr Warner, Supervisor, District One

Luke Parkes, Supervisor, District Two

Mike Peterson, Supervisor, District Three Gloria Turnipseed, Supervisor, District Four Larry Duran, Supervisor, District Five Chancery Clerk Julie Cunningham

Which motion received the unanimous vote of the members of the Board of Supervisors.

This discussion of the nature of matters requiring executive session was had, and the Board, on motion made by Honorable Mike Peterson, Second by Honorable Gloria Turnipseed, and approve by unanimous vote, declared the Board of Supervisors to be in executive session for the consideration of such matters.





ORD_ER TO EXIT EXECUTIVE SESSION

CAME ON FOR CONSIDERATION at the request of Honorabie Mike Peterson the exit of the Executive Session.

After discussion and upon said request, Motion was made by Honorable Luke Parkes and Second by Honorable Larry Duran to exit Executive Session and that the

meeting again be opened to the public, with no action being taken during Executive Session.

QRDER APPRMNG EMERÉNCY LEASE OF KONICA COPIER FOR EMERGENCY MANAGEMENT DIRECTOR BUILDY KING, MAGNQLIA BUSINESÃ SYSTEMS

CAME ON FOR CONSIDERATION at the request of Winston County Emergency Management Director Buddy King, approvai for the emergency lease of a copier from Magnolia Business Systems, at a cost of $464.93 per month. The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies ofthe extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental

of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

Therefore, after discussion and upon said request, Motion was made by Honorable

Luke Parkes and Second by Honorable Burr Warner to approve said emergency lease of copier for the EMA office.

ORDER TO EMPLOY DISASTERPROJECTMANAGER AND TO SOLICIT REQUESTS FOR PROPOSALS FOR DEBRIS REMOVAL AND MONITOR

THERE CAME ON FOR CONSIDERATION by the Board of Supervisors the matter

of the county employing a disaster project manager and soliciting requests for proposals through the project manager for debris removal and monitoring services.

The Board finds that it is necessary to enter into a contract for the removal of debris and for the monitoring of the debris removal in order to protect the lives and property of the citizens of Winston County. Specifically, the Board finds that citizens of the county are endangered by the debris left in the public roads and public road rights of way by the tornado which struck Winston County on April 28, 2014. Further, the Board ñnds that the county may be entitled to be reimbursed by the Mississippi Emergency Management Agency (MEMA) and the Federal Emergency Management Agency (FEMA) for certain expenses related to removal of the debris. The Board finds that due to the emergency declaration in effect by the Board of Supervisors, the City of Louisville, the Governor of the State of Mississippi and the President of the United States that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencias ofthe extreme emergency situation without regard to timeconsuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materialsl and the appropriation and expenditure of public funds. However, the Board finds that in order to be eligible for reimbursement of expenses from MEMA and FEMA, it must follow certain procurement practices which include seeking competitive proposals for the removal of debris and the monitoring of the debris removal, including seeking these services from minority owned businesses. Therefore, the Board of Supervisors finds that it should employ a disaster project manager to send out requests for proposals for debris removal and for monitoring services for debris removal for all areas ofthe county

outside the municipal limits of the City of Louisville in need of cleanup due to the tornado disaster of April 28, 2014.

Therefore, after discussion and upon said request, Motion was made by Honorable Gloria Turnipseed and Second by Honorable Burr Warner to employ a disaster project manager and to solicit Request for Proposals for debris removal and monitoring services for debris removal following the procurement guidelines of MENIA and FEMA.

ORDER RECESSING THE WINSTON COUNTY BOAßD OF SUPÉRVISORS MEETING TO 9:00 A_M, WEDNESDAY, M_M 14, 2014

CAME ON FOR CONSIDERATION at the request of Honorable Luke Parkes, to recess this meeting ofthe Board of Supervisors until Wednesday, May 14, 2014, at 9:00 am, for the purpose of selecting a project manager to assist the Board of Supervisors in

sending out requests for proposals for debris removal services and monitoring services needed due to the April 28, 2014 tornado.

After discussion and upon said request, Motion was made by Honorable Larry Duran

and Second by Honorable Gloria Turnipseed to recess said meeting to Wednesday, May 14, 2014, at 9:00 am.
