Emergency Meeting.' Bid Opening for Demolition of Building K, Teters Building

BE IT REMEMBERED that the Board of Supervisors of Winston County, Mississippi held a meeting at the Courthouse in the City of Louisville, Mississippi, at 9:00 am, this the 9th day of May, 2014, for the purpose of discussing imminent threats to the safety of the public health and safety of our citizens caused by the April 28, 2014 tornado. Said tornado devastated many areas of Winston County, Mississippi, and the Winston County Board of Supervisors was seeking the help of State and Federal Government entities. At the time of this meeting, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor ofthe State of Mississippi and the President of the United States.


Present and constituting the Board was Honorable James “Burr” Warner, District One; Honorable Luke Parkes, District Two; Honorable Mike Peterson, District Three; Honorable Gloria Turnipseed, District Four; and Honorable Larry Duran, District Five. Also present were FEMA representatives Greg Bosco and Laura Henessy, MDEQ representative Jason Bridges, MEMA representative BJ Hailey, Board Attorney Hugh Hathorn, Honorable Jason Pugh, Honorable Julie Cunningham, Chancery Clerk of Winston County, Honorable Larry Woodward, Tax Assessor-Collector of Winston County, Joseph McCain from The Winston County Journal, Deputy Keith Alexander, and Bookkeeper Debbie Sullivan. Also present were William McCully from Winston Web News, and Buddy King, EMA Director.

The Board, having been declared in session at 9:00 am, by Honorable Jason Pugh, Sheriff of Winston County, Mississippi, with Honorable Mike Peterson, President ofthe Board of Supervisors presiding, proceeded with business as follows, to-wit:

ORDER TO OPEN BIDS ON THE DEMOLITION OF SECTION K (WAREHOUSEI OF THE TETERS BUILDING (SPARTUS BUILDING) DAMAGED BY TH; APRIL 28, 2014 TORNADO

CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, the opening of bids for the demolition Section K of the Teters Building, also known as the Spartus Building, due to damage received from the April 28, 2014 tornado. The Board finds that it is necessary to demolish the building and remove the debris in order to protect the structural integrity of the remainder of the building. The April 28 tornado caused destruction at the Winston Medical Center, therefore impacting the daily function of essential services to the citizens of Winston County, Mississippi. The Board also finds that due to the destruction of the Winston Medical Center and the destruction of the medical offices of the local physicians, it is necessary to protect the health and safety and the lives of the citizens of Winston County, Mississippi, to construct a portable Hospital and the premises of the Teters Building, which is owned by the

county, is a suitable piace that meets the needs and requirements of the portable hospital.

The Board further finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencias of the extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

Bids were solicited by Stanley Spradling of Spradling-Calvert Engineers. Four bids were submitted for the above mentioned demolition:

Continental Rana and Excavating, Inc. - $350,000.00 Century Construction and Realty, Inc. - $44,850.00 McDevitt, Ent- $105,000.00

M & M Services, Inc. $650,000.00

After discussion and upon said request, Motion was made by Honorable Luke Parkes and Second by Honorable Gloria Turnipseed to take bids under advisement.

Motion passed on the following vote:

ORDER ACCEPTING BID FROM CEETURY CONSrTRUCTION AND REMY. INC., FOR §44,850.00

CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, acceptance of the bid from Century Construction and Realty, Inc., for $44,850.00 for the removal of Building K (Warehouse) at the Teters Building (Spartus Building). The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds. The Board further ñnds that this work is necessary to protect the building and property from further damage and to protect the lives and property of the citizens of Winston County.

After discussion and upon said request, Motion was made by Honorable Luke Parkes and Second by Honorable Larry Duran to accept said bid and to issue a Notice to Proceed, the Date of Substantial Completion being May 12, 2014 at 3:00 pm.

ORDER REQESSING THE WINSTON COUNTY BOARD OF SUPERVISORS ON A DAY-TO-DAY BASIS DUE TO TORNADO DISASTER

CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, recess of the Winston County Board of Supervisors on a day-to-day basis as may be needed during the state of emergency. The Board of Supervisors, having previously declared a local state of disaster and emergency under the provisions of Section 33-155 of the Mississippi Codel finds that it may be necessary to meet as a public body on a day to day basis in order to assess the needs of the citizens of the county and to take

urgent and immediate action in order to protect the lives and property of the citizens of Winston County.

Therefore, after discussion and upon said request, Motion was made by Honorable Gloria Turnipseed and Second by Honorable Burr Warner to approve recessing this meeting and meeting on a day to day basis as needed to provide such action and

orders as may be necessary to protect the lives and property of the citizens of Winston County.
