Board Minutes- May 19, 2014

BE IT REMEMBERED that the Board of Supervisors of Winston County, Mississippi, held a regularly scheduled meeting at the Courthouse in the City of Louisville, Mississippi, at 9:00 am, this the 19th   day of May, 2014, the same being duly noticed and posted to all necessary parties. At the time of this meeting, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.


    Present and constituting the Board was Honorable James “Burr” Warner, District One; Honorable Luke Parkes, District Two; Honorable Mike Peterson, District Three; Honorable Gloria Turnipseed, District Four; and Honorable Larry Duran, District Five.  Also present were Board Attorney Hugh Hathorn, Honorable Jason Pugh,  Honorable Julie Cunningham, Chancery Clerk of Winston County, Joseph McCain from The Winston County Journal,  Deputy Keith Alexander,  and Bookkeeper Debbie Sullivan. Also present were William McCully from Winston Web News, WCCRCF Warden Neal Higgason, Circuit Clerk Kim Ming, Brenda Miles, Thurman Eichelberger, Elmetra Patterson, Audrey Griffin, Angie Griffin, Mike Forster, Richard Moncrief, and Buddy King, EMA Director.



The Board, having been declared in session at 9:00 am, by Honorable Jason Pugh, Sheriff of Winston County, Mississippi, with Honorable Mike Peterson, President of the Board of Supervisors  presiding, proceeded with business as follows, to-wit:

    CAME ON FOR CONSIDERATION at the request of Gerald Mills, Director of the Louisville-Winston Economic Development District, and pursuant to MS Code 65-7-4, the addition of the Stringer Industrial Park Road as a public road, amending the Winston County Road Register and map to include said road.

   CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, approval for the emergency purchases of meals for Law Enforcement officers following the April 28, 2014 tornado disaster in Winston County, Mississippi. At the time of this purchase, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.  


    After discussion and upon said request, Motion was made by Honorable Burr Warner and Second by Honorable Luke Parkes to approve said emergency purchases at Fresh Market Grill (formerly Luigi’s).  Said funds will be paid from Disaster Fund 045 and should be reimbursable by FEMA.

   CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, approval for the emergency purchases of signs at a cost of $590.00 following the April 28, 2014 tornado disaster in Winston County, Mississippi. At the time of this purchase, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

   CAME ON FOR CONSIDERATION at the request of Honorable Mike Peterson, approval for the emergency rental of porta-potties and grinder at a cost of $24,714.10 from Pearson Plumbing following the April 28, 2014 tornado disaster in Winston County, Mississippi.  Said rental was for the safety, health, and welfare of the citizens of Winston County, Mississippi.  At the time of this equipment rental, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

    CAME ON FOR CONSIDERATION at the request of Buddy King, Winston County Emergency Management Director, approval for the emergency repair or replacement of fire/law enforcement repeater site at a cost of $21,032.72 from Precision Communications.  Said purchase and/or repair is necessary for the safety, health, and welfare of the citizens of Winston County, Mississippi, and necessary to protect the lives and property of the citizens of Winston County.  At the time of this purchase, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. ORDER TO PAY CHRISTOPHER CANADY FOR 7 HOURS EMERGENCY SECURITY DUTY DUE TO THE APRIL 28, 2014 TORNADO


    CAME ON FOR CONSIDERATION at the request of Warden Neal Higgason, approval for payment to Christopher Canady for 7 hours security duty, ($123.06) due to the April 28, 2014 tornado in Winston County, Mississippi.  The services of Officer Canady were needed for the safety, health, and welfare of the citizens of Winston County, Mississippi.  At the time these services were acquired and rendered, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.

Jason Jones for 7 hours security duty, ($127.26) due to the April 28, 2014 tornado in Winston County, Mississippi.  The services of Sgt. Jones were needed for the safety, health, and welfare of the citizens of Winston County, Mississippi following the tornado.  At the time these services were acquired and rendered, Winston County was operating under an Emergency Disaster Declaration proclaimed by the Board of Supervisors, the Mayor and Board of Alderman of the City of Louisville, the Governor of the State of Mississippi and the President of the United States.The Board finds that the provisions of Section 33-15-17(b), Miss. CODE ANN. (1972, as amended), grant the county the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of such disaster and that said statute authorizes the county to exercise the powers vested under this section in the light of the exigencies of the extreme emergency situation without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the appropriation and expenditure of public funds.
