VOIP Resolution Adopted June 17, 2013

The Board of Supervisors of Winston County, Mississippi took up the matter of the need for official action to implement the authority granted to the County under Senate Bill No. 2938, 2010 Regular Session, Mississippi Legislature, amending Mississippi Code Annotated Section 19-5-313 (1972) and imposing  a service charge on Voice over Internet Protocol (“VOIP”) subscribers in the Winston County.  After full discussion of the subject, Supervisor______________ offered and moved the adoption of the following Resolution.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WINSTON COUNTY, MISSISSIPPI, IMPLEMENTING AUTHORITY GRANTED BY SENATE BILL NO. 2938, 2010 REGULAR SESSION, MISSISSIPPI LEGISLATURE, IMPOSING A SERVICE CHARGE ON VOICE OVER INTERNET PROTOCOL (“VOIP”) SUBSCRIBERS IN WINSTON COUNTY.
I. 
In the 2010 Regular Session of the Mississippi Legislature, Senate Bill No. 2938 was enacted and subsequently signed into law by the Governor, which bill amended Miss. Code Ann. § 19-5-313 (1982) by authorizing the Board to levy an emergency telephone service charge in the amount of One Dollar ($1.00) per residential VOIP subscriber account and Two Dollars ($2.00) per commercial VOIP subscriber account per month throughout the County.
                                                               II.
The Board of Supervisors of Winston County, Mississippi desires to exercise its authority to levy such an emergency service charge in the amount of One Dollar ($1.00) per residential VOIP subscriber account per month, and Two Dollars ($2.00) per commercial VOIP subscriber account per month, except that this charge shall not be imposed upon more than twenty-five (25) VOIP lines per commercial subscriber account per location, which charge shall have uniform application to include re-sellers, bundled packages that include phone service, and new and emerging technologies that provide service to Winston E-911, and is to be imposed throughout the entirety of the County in conformity with the availability of such emergency response service in the County.
NOW, THEREFORE, BE IT RESOLVED by the Board that there is hereby levied an emergency telephone service charge in the amount of One Dollar ($1.00) per residential VOIP subscriber account per month in Winston County, and Two Dollars ($2.00) per commercial VOIP subscriber account per month, except that no such service charge shall be imposed upon more than twenty-five (25) commercial VOIP lines per location.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the Board that this charge shall be collected by every VOIP service supplier commencing upon the date of this Resolution’s effectiveness which shall be _______ (__) days after its passage, and that the Clerk of the Board is directed to distribute a copy of this Resolution to every VOIP service supplier providing service in Winston County.   
Following the reading of the foregoing resolution, Supervisor ________________ seconded the motion for its adoption.  The President put the question to a roll call vote and the result was as follows:
